Dream11 has approached the Bombay High Court to challenge show cause notices issued by tax authorities, alleging Goods and Services Tax (GST) evasion of over ₹1,200 crores for the financial years 2017-18 and 2018-19. The notices claim a 28% GST on Dream11's services related to gambling.
The petitioner, Sporta Technology (Dream11's owner), argues that GST on actionable claims cannot be imposed, as they merely provide a platform. Sporta also contends that the notices are against the Supreme Court's stance that online fantasy sports are games of skill, not gambling.
The plea specifically challenges the investigation initiated by tax authorities and the retrospective application of GST amendments effective from October 1, 2023. Additionally, the petitioner questions Section 15(5) of the Central GST Act, claiming it grants excessive power to officers to fix the value of supplies for taxation purposes based on GST council recommendations.
The tax allegations against Dream11 reportedly total Rs 40,000 Crores, potentially making it the largest-ever claim in Indian indirect taxation history. Dream11 is a leading player in India's fantasy gaming sector, with a valuation exceeding $8 billion and over 180 million users on its platform.
