Mumbai Man Gets 10 Years Rigorous Imprisonment after eloping with a minor

On Monday, the Special Protection of Children from Sexual Offences (Pocso) Act Court handed a 10 year Rigorous Imprisonment to a 23 Year Old man from Mumbai from eloping with a minor and committing sexual assualt with her. The most shocking point was that the girl was the maternal niece of the person.

The Girl in her testimony claimed that the two of them were in a relationship. The Court has pointed out that the accused had taken the advantage of her mental health and instead of counseling with the elders, he eloped with her.

Due to this action the Court has observed him for Kidnapping and Rape. "He had sexual relations with the victim on more than one occasion and therefore he has committed aggravated sexual assualt." The Court had also imposed a fine of 25,000 Rs.

One day the victim was scolded by her mother for waking up late. She then went to college but didn't return home and switched off her phone. After a missing persons complaint was filed, the mother disclosed that she was in a relationship with her maternal uncle(the Accused).

During Investigation the police found out that the two of them had eloped to Pune and were living their as a married couple. She would agree that she ran away due to pressure from studies and had asked the accused to take her to Pune where they could settle down.

Depsite the statements of the Defence, the Prosecution proved that the girl was 16 years and 11 months old during the time of the marriage and not 18 Years(The Legal Age) and the marriage between them is prohibited as per the Hindu Marriage Act.
