SC dismisses plea seeking Justice Chandrachud's restrainment from taking oath as next CJI.

Justice DY Chandrachud

On Wednesday, the Supreme Court dismissed the plea seeking to restrain Justice DY Chandrachud from taking oath as the next Chief Justice of India terming the petition as misconceived.

A bench led by Chief Justice of India UU Lalit dismissed the advocate's petition, stating that there is no reason to entertain the plea and that it lacks merit. The petition was also deemed misconceived by the court.

Earlier, the petitioner mentioned the plea seeking an urgent hearing on it.

  • The petitioner relied on two arguments to support his case, telling the court that during Covid 19, when a senior advocate appeared, his matter was tagged, but when a junior advocate appeared, his plea was denied.
  • The petitioner also claimed that Justice Chandrachud had forced the litigant to take the covid vaccine.

On November 9, Justice Chandrachud will take oath of office as the 50th Chief Justice of India as Current CJI UU Lalit will step down on November 8 after a brief tenure of 74 days as the head of India's judiciary.
