Lakhimpur Kheri violence: 'Attempt to Murder' charges among others sought by SIT against all accused; says it was 'pre-planned conspiracy'

As per the SIT (Special Investigation Team), the Lakhimpur Kheri violence that led to the death of five people and left several injured, was a 'pre-planned conspiracy'.

  • Denying earlier charges of callousness or negligence against the accused, SIT officer Vidyaram Diwakar said that the act was deliberate, with an intention to kill. However, prime accused Ashish Mishra, son of Union Minister of State for Home Affairs Ajay Kumar Mishra 'Teni', have denied the charges.

SIT requested the court that IPC Sections 307, 326, 34 along with Sections 3, 25 and 30 of the Arms Act be invoked in addition to the charges mentioned in the FIR (of murder and criminal conspiracy, among others) against all 13 accused. The court is yet to decide on the SIT’s application.

  • While IPC Section 307 relates to attempt to murder charges, 326 covers voluntarily causing grievous hurt by dangerous weapons or means and 34 acts done by several persons in furtherance of common intention.

Earlier on November 17, the Supreme Court appointed Rakesh Kumar Jain, former judge of the Punjab and Haryana High Court to monitor the investigation in the Lakhimpur Kheri violence case to ensure transparency, fairness, and absolute impartiality.

  • Local farmers had blamed Union Minister of State for Home Affairs Ajay Kumar Mishra 'Teni' and his son Ashish Mishra for the violence that left eight dead, including four farmers a local journalist, and others during a farmers' protest. They were mowed down by a vehicle that was part of the convoy of the Minister in Lakhimpur Kheri in north-central Uttar Pradesh.

Videos were being circulated on social media where a Mahindra Thar was seen knocking down protesters from behind.
